University Grants Commission, NewDelhi
is the only statutory authority in India, to grant the status of "University" to an educational body. Section 2(f) of the
University Grants Commission Act stipulates that 'only a University established by an act of parliament, state legislature
is called "univserity" and empowered to grant degrees under section 22 of UGC Act.
Government of India has passed a Private Universities Bill 2002 and is yet to become an act.
Now if ever the Billbecomes a law, there may be a handful of Private Universities in India competing each other in their respective
field of excellence.
However, after demarcation of Chattisgargh and Uttranchal as seperate states/province, the
Chattisgargh Government brought out an act'Private Universities Act' to enable 'a person, a society, trust or any other
similar institutuions to set up private universities in Chattisgargh and establish study centers through out India. The said
act is to become operational in the state of Chattisgargh. But an act passed by one state government is valid throughout India.
Apart from five state run universities, the government permitted 112 Private Universities in
their state. Most of them established few hundred study centers in all parts of India by collecting study center set up fee
ranging from 15 thousand to one lakh depending upon the area of the center.
Many such Universities even enrolled students from all over India offering all, anything to
everything, degrees by correspondence. A few of them enrolled students for coveted degrees like MBA, MCA,BEd, LLM, Nursing
Degrees and so on..
A 'leading private University' enrolled ten thousand students for their BEd distance education
course by collecting Rs tenthousand per year for a two year course stating that the university is about to get recognition
and approval from National Teaching Council of India , an
apex body of the government of India under HRD. This University called itself as 'Anna Technological University' similar to
the state run 'Anna University'. Such a deception brought thousands of students into their deceitful tacticts.
But accidently it was announced by the Government of CG, that this University is not recognised
by the govt. One could find in their prospectus the statement that this ATU is recognised and established under section ....of
CG Private Universities Act as per CG Government notification number.... etc and recognised by Government of India, UGC under
section 2(f) and 22 of the UGC Act.
The information is found to be false owing to the fact that the gazzette notification etc mentioned
in their prospectus refers only to the establishment of CG Pvt University Act. It does nothing to do with these universities.
Many study centers were mislead by this, and paid fee to become a 'study centers' of the so called private universities.
Another example is 'Commercial University' established by 'All india Commercial Association'
in 1947 at Lahore and moved its head quarters to New Delhi after partition of India. This was a "Ltd" University with
an object of promoting education. It has been 'awarding degrees for a fee payment'. After CG act, this CU, issued prospectus
stating that it was duly recognised under .... CG Act, UGC, etc. This CU even collected 1.40 lakhs for a study center. A notification
issued by CG government didnot find the name of CU.
Like the above examples, there are many universities manipulating the laws and misrepresenting
in their prospectusses.
The information appearing in the
newspapers as to their advertisements were left unnoticed by many law enforcing authorities.
